State Immunity - Latest Developments - 17th June 2014

Propeller Club Logo for Website"English Commercial Court decision erodes State Immunity Defence"

The Propeller Club is delighted to announce an event concerning a case set to have a significant impact for international traders confronted by state immunity defences. The English Commercial Court has held that Iraq's national oil trading company, SOMO, has a separate corporate status from the Iraqi State and is therefore not entitled to rely on state immunity to avoid payment of a final arbitration award of US$9 million. Those funds are held in Court.

This unusual case involves the successful arrest of a debt payable under an LC, secured by way of a third party debt order, rather than a freezing order.

The talk will be accompanied by a drinks reception and dinner.
